Former SRCI corrections officer found guilty
Tomi Sue Fowler will most likely be placed on probation



ONTARIO—A former Snake River Correctional Institution corrections officer was found guilty on two of six charges Thursday in Malheur County Circuit Court.

Tomi Sue Fowler, 40, Ontario, was found guilty of unlawful manufacture of marijuana, a class A felony, and supplying contraband, a class C felony. She was acquitted on charges of two counts of first-degree custodial sexual misconduct, one count of second-degree custodial sexual misconduct and second-degree official misconduct.

She and her husband, James Matthew Fowler, 29, were arrested in August 2007 after Oregon State Police searched their house while investigating possible misconduct involving sexual relations with an inmate by Tomi Sue Fowler at SRCI. Police found marijuana growing in the couple’s basement, according to a press release from the Malheur County District Attorney’s Office Friday. Matthew Fowler pleaded guilty to one count of manufacturing marijuana previously.

Tomi Sue Fowler’s supplying contraband charge involves bringing in contraband and providing it to an inmate to make sure she was not caught, Malheur County Deputy District Attorney Erin Landis said Friday.

Despite being convicted on two felony charges, Tomi Sue Fowler will likely receive probation, Landis said. That would not have changed if she had been convicted on all the charges.

“Well, even if she was found guilty of all of those, she probably would have been given probation under Oregon state guidelines,” he said.

It will be up to the presiding judge at Tomi Sue Fowler’s sentencing, scheduled for Oct. 8 at Malheur County Circuit Court, to determining what her actual sentence will entail.

Landis said the D.A.’s Office considers the conviction a success.

“This is something that affects the safety and security of the inmates and, perhaps more importantly, the safety of the corrections officers at the institution,” he said. “When you take cases to trial and secure two felony convictions and you hold a person accountable, that’s a success.”

Landis pointed out this case was unusual, and the first he has dealt with in six years at the D.A.’s office.

“This is the exception to the rule with these corrections officers,” Landis said.

" How could anyone dare to sit here and write bad about this former officer? To all the female officers out there not supporting Tomi...please do realize that one day...that could very well be you sitting in that seat in the court room. Having the people and the system your suposed to feel comfortable with protecting you, come in and completely destroy everything that you've worked so hard for. Tearing your life apart until you have nothing left except the love and support of the people who truly know you! Maybe one day...Tomi Folwlers case is going to save your butt and you will thank her for the hardships she, i'm sure has gone through to prove her inocence (When it never should have gone this far)!!! Because it's very obvious where the coruption in the system lies! I think for all the doubters of Tomi's innocence should have been at the trial to see the big picture...the lies Landis made in his arguements that made him look like a complete fool and completely proved Tomi's innocence!
How is it okay for the inmates to have been debreifed with before the trial, on what they needed to say? And shown NUDE photos of this officer? I find that a complete violation of anything ethical! Regaurdless in any case...innocent or not...it should have never been alright for convicted murderers and someone who will be in and out of prison for the rest of his life to have seen nude photo's of a former officer! I just have so much discust and lack of faith with Oregon DOC and OSP for what they have put Tomi and James Fowler through this last year!

Now while sitting here reading through the other blogs, I realize how people view the positive and negitive comments made about this case...positive=must be good friends with tomi and they are sticking up for her....negitive=must be DA Landis...or someone involved with the states case still trying to prove her inocence as guilty to the uneducated...now take this into consideration......

The fact is...
when the details of this case were released into the media I had no clue who Tomi Fowler was! I just logged onto aol and that was the featured story! I thought to myself how terrible it would be to be put in a situation like that!

Then, I decided to attend the trial in eastern Oregon...I sat through the entire trial...everyday from start to finish! I did not know Tomi Fowler's story...I didn't know the all the inside details...I knew the basics of it...an officer ACCUSED of having a sexual relationship with a COLD BLOODED KILLER! I took notes of all the discrepancies in the states' witnesses 'stories'. Also including in my notes was the information the witnesses of the defendant put forth! Now I'll tell you what...I had endless pages of notes of unmatching stories on the states side, stories that never remained the same, information..."not being recalled" at that moment in time. (Ironic, don't cha think?) My notes for tomi fowler's witnesses? Let's just say I got 'em all on one page...(compared to about the fifteen i had proving the state to be diceitful)!!!

So please...learn the facts of the trial...not many of you were there...believe me...I saw...

I believe with all my heart and mind, that Tomi S. Fowler is completely innocent! Next time you feel like judging and speaking up about something...make sure you have your facts straight...and your not going with the "HE SAID SHE SAID" bull honky...I can not wait for Tomi for appeals! So Tomi can have the complete innocence that she deserves! My heart and prayers go out to Tomi and her family...and I'm still in shock with the lack of proof in this case...that it ever even made it to trial...what an embaressment to the State of Oregon!!! "

There is a HUGE misconception by the general public who believe that medicinal marijuana patients just go to a pharmacy and pick up their medicine. This is absolutely false. " Just because you may have a medical marijuana card, doesn't mean you can grow it. He may have one, but it has to be prescribed just like any other medication. Growing is illegal unless you have a growers licence. Get it straight! Besides, I can think of a whole lot worse things that they could have been doing. When was the last time you heard of someone beat their wife because they were high on marijuana? Or killed someone in a car accident because they were stoned, huh? Didnt think so. " Police found 1 4inch sprout in the couples basement while searching their home looking for a letter an inmate said he wrote (strangely, no other evidence was needed for a search warrant). Excessive? James has had cancer since 2005 and now suffers from nerve damage due to his surgery. Ask anyone who worked with him how well he was able to work after he got sick. Then ask those same people how he's doing now that he is a medical marijuana patient. Not medically necessary? You don't seem to understand that the contraband charge was directly linked to the sexual charges. The states case for the contraband relied completely on the sexual charges for which she was acquitted (that means innocent, aka not guilty). Detective Ken Pecyna admitted on the stand to showing inmates photographs of parts of Tomi's body they were suppose to later describe while prepping for Trial. This came from his mouth on the witness stand. I was there. Bogus conspiracy? So why was Tomi convicted of anything if she's innocent?

A. Erin Landis promised to drop the marijuana charge if James plead guilty to a possession charge, even though he was fully covered by the affirmative defense he plead in order to save his wife from the charge. 3 days before trial Landis backed out of the deal leaving Tomi with no defense.
B. Tomi's lawyer did not file the proper motions within the allowed time frame leaving her with no defense for the marijuana charge.
C. During deliberations the jury completely forgot that the States case for contraband relied totally on the sexual charges. Claiming the diet pills were to pay an inmate to keep watch while she had sex. Obviously, she was proven innocent of the sexual charges meaning if she wasn't having sex, then she wasn't paying someone to keep watch. The verdict makes no sense and WILL be appealed. I just hope the Argus prints a nice big cover story when Tomi is exonerated.

Just keep believing the system works. Keep trusting the people in law enforcement. When it happens to you, you'll find out how things really work in this world. I hope that never happens. "

" I will say this much, for months many people have gotten defensive regarding what happened to Ms. Fowler and her husband as if she is a victim. Many of you speak as if you have first hand knowledge of what happened. Is this because she told you so, or you were actually there?

Be it as it may, the people at the DA Office, the Argus, Snake River all have a job to do, and when something of this caliber directly affects you then it is all bogus and conspiracy. Let's be honest with ourselves, drugs or multi vitamins is still a violation of her previous employment. Medical marijuana grown in large amounts, well that is excessive as well. If Ms. Fowler and Mr. Fowler felt his medical prescription was legally in their home and could produce documentation to support such, then they would have never been found guilty of the crime.

To the employee at SRCI, the rumors and stories that come out of that place run more deep than what the Argus prints. The Argus is no different than the local news or CNN or major city newspapers. They are going to print and cover the story that will sell thier product, bottom line! That is what people read, just as you found the time to read the article. It is unfortunate that people have to deal with the stories that get printed, but freedom of speech allows this to happen along with your blog and mine.

I will say that with any profession, you will have the good and the bad, so please do not think that when SRCI have numerous incidents involving employees or ex- employees that the that is the norm. Numerous good people with credibility and integrity works there. They are our neighbors, friends and families that haeva tough job. Thank all the hard working people of SRCI and I will say to the others, why subject all employees to home raids. I would agree with randon urine tests and in depth searches of employees as the enter the workplace. Just a thought. "

" Even after moving away more than 4 years ago, I find it sad to see these articles regarding SRCI employees. Since they are the largest employer in the area, I suppose they also have larger targets on their backs. The one question that always seems to go unanswered is, "Why don't they random drug test employees at SRCI"? I know my ex and most of his friends would be found using illegal drugs, and I don't just mean pot. How many drug raids are carried out at other employee's homes? When wrong-doings are reported, the reports have fallen on deaf ears. I guess it isn't what you do but how long you've been there and where you rank and how many behinds you kiss. As for sexual misconduct... it is rampant out there, but between the employees, not so much the inmates. I am sure this won't get printed, so I won't even go into the "Swinger Parties". "

" Funny the Argus saw fit to print everything about the arrest all over the front page. Where was this story? Oh and why wasn't it stressed she was found innocent on the sexual conduct charges. Which anyone who worked out there knew she didn't sleep with an inmate.
It was very nice of the detective involved to show the inmates photos of Tomi's tattoos that they didn't know about BEFORE the trial. I guess that was to help the inmates "remember".

Finish the sentence Landis, "to make sure she was not caught......." Having sex, but wait! She was acquitted of that, so what was she not trying to not get caught doing? The jury got so caught up in deliberations that they forgot the key element of this charge relied on the sexual charges. The States (and Landis') claim was that she was bringing in diet pills to pay an inmate to keep watch while she had sex. However, Tomi Fowler was found NOT GUILTY of all the sexual charges and therefor proved her case for the contraband as well. The marijuana charge is a joke, Tomi's husband James has cancer, has had it since 2005 and is a Oregon Medical Marijuana patient. This entire case was a monstrous waste of tax payers money. I would imagine the States bill for this case is close to 6 figures, if not more. A state trooper from Ontario was making weekly trips to Salem to talk to one of the inmate witnesses for 15 minutes once a week on the clock. Tomi WILL win on appeal, no doubt about it. "
